Tomcat JSP compiler and JDK licensing

If I want to distribute my app that uses Tomcat/Jasper for compiling JSPs, I have to make sure that Tomcat is run with a JDK not a JRE (tools.jar must be present for Tomcat/Jasper to work). Problem is, I don't want to include a full JDK in my app distribution (it's too big and Sun may not allow that). So how do I legally distribute an app that needs to compile JSPs without including the entire JDK? IIRC, I'm not allowed to distribute just tools.jar - is that correct?
